Welcome to SuitedNoir. These Terms of Service ("Terms") govern your access to and use of the SuitedNoir website, products, and services. By accessing our website, placing an order, or using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or purchase our products.

1. COMPANY INFORMATION

Throughout these Terms, "SuitedNoir," "Company," "we," "our," and "us" refer to SuitedNoir.

2. ELIGIBILITY

By using our website and services, you represent and warrant that:

  • You are at least 18 years of age or have the permission of a parent or legal guardian.

  • You have the legal capacity to enter into a binding agreement.

  • All information provided by you is accurate, current, and complete.

3. PRODUCTS AND SERVICES

SuitedNoir specializes in custom-made, made-to-order, and personalized menswear and accessories.

Products may include but are not limited to:

  • Suits

  • Jackets

  • Trousers

  • Shirts

  • Coats

  • Outerwear

  • Accessories

  • Custom apparel and related products

All products are manufactured specifically after an order is placed.

4. PRICING AND PAYMENT

All prices displayed on the website are subject to change without notice.

We reserve the right to:

  • Correct pricing errors.

  • Modify pricing at any time.

  • Refuse or cancel orders affected by pricing inaccuracies.

Full payment must be received before production begins.

5. ORDER ACCEPTANCE

Submission of an order does not guarantee acceptance.

SuitedNoir reserves the right to:

  • Refuse any order.

  • Limit quantities.

  • Cancel suspicious or fraudulent transactions.

  • Refuse service to any customer at our sole discretion.

If an order is canceled before production begins and payment has been collected, a refund will be issued in accordance with applicable laws.

6. CUSTOM-MADE PRODUCTS

All SuitedNoir garments are custom-made, made-to-order, or produced specifically for individual customers.

By placing an order, you acknowledge and agree that:

  • Your garment is manufactured specifically for you.

  • Production may begin shortly after order confirmation.

  • Materials and labor are allocated specifically to your order.

  • The product cannot be resold to another customer.

  • Custom-made products are generally not eligible for return, exchange, or refund except where required by applicable law.

Customer approval of measurements, sizing, fabric selections, style choices, design details, or production specifications constitutes final authorization to begin production.

7. ORDER CANCELLATIONS

Orders may only be canceled within 24 hours of purchase and only if production has not yet started.

Once production has begun, cancellations are not permitted.

Approved cancellations may be subject to payment processing fees, transaction fees, or administrative costs.

8. MEASUREMENTS AND SIZING

Customers are solely responsible for providing accurate measurements, sizing information, and fitting preferences.

SuitedNoir is not responsible for issues resulting from:

  • Incorrect measurements submitted by the customer.

  • Incorrect size selection.

  • Weight changes after ordering.

  • Body shape changes after ordering.

  • Measurements provided by third parties.

Due to the handmade nature of custom garments, minor variations in measurements, stitching, fabric placement, pattern alignment, and finishing details may occur and shall not be considered defects.

Minor alterations may be necessary to achieve a preferred fit and are considered a normal part of the custom tailoring process.

9. PRODUCT REPRESENTATION

We strive to display products, fabrics, and colors as accurately as possible.

However, we cannot guarantee that your device will display colors accurately.

Customers acknowledge that:

  • Colors may vary due to monitor settings.

  • Fabric texture may differ slightly from photographs.

  • Lighting conditions may affect product appearance.

  • Final garments may differ slightly from images displayed on the website.

Such differences do not constitute defects.

10. FABRIC AVAILABILITY

Occasionally, selected fabrics or materials may become unavailable due to supplier shortages or discontinuation.

In such cases, SuitedNoir reserves the right to:

  • Offer a comparable replacement fabric of equal or greater quality.

  • Contact the customer to select an alternative material.

  • Cancel the order and issue a refund if a suitable replacement cannot be agreed upon.

11. SHIPPING AND DELIVERY

Production and delivery timelines are estimates only and are not guaranteed.

SuitedNoir is not responsible for delays caused by:

  • Shipping carriers.

  • Customs inspections.

  • Weather conditions.

  • Supply chain disruptions.

  • Labor shortages.

  • Government actions.

  • Force majeure events.

Customers are responsible for providing accurate shipping information.

Additional shipping charges may apply if an order must be reshipped due to incorrect customer-provided information.

12. INTERNATIONAL ORDERS

Customers are responsible for:

  • Import duties.

  • Customs fees.

  • Taxes.

  • Brokerage charges.

  • Compliance with local import regulations.

SuitedNoir is not responsible for delays, fees, or restrictions imposed by customs authorities.

13. DAMAGED OR DEFECTIVE PRODUCTS

Customers must inspect their order upon delivery.

Claims relating to manufacturing defects, damage, or incorrect products must be submitted within seven (7) days of delivery.

Claims must include:

  • Order number.

  • Description of the issue.

  • Clear supporting photographs.

SuitedNoir reserves the right to determine the appropriate remedy, including repair, replacement, remake, store credit, or refund where applicable.

14. CHARGEBACKS

Customers agree to contact SuitedNoir directly regarding any concerns before initiating a chargeback or payment dispute.

By placing an order, customers acknowledge that custom-made products enter production specifically for them and may not be eligible for cancellation, return, refund, or chargeback except where required by applicable law.

SuitedNoir reserves the right to dispute chargebacks using production records, communications, shipping confirmations, proof of delivery, and other supporting documentation.

15. INTELLECTUAL PROPERTY

All website content, including but not limited to:

  • Logos

  • Trademarks

  • Product designs

  • Images

  • Text

  • Graphics

  • Marketing materials

  • Website content

is the exclusive property of SuitedNoir and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

16. PROHIBITED USES

You agree not to:

  • Violate any applicable laws.

  • Submit false information.

  • Interfere with website security.

  • Attempt unauthorized access to systems.

  • Engage in fraudulent activities.

  • Use the website for unlawful purposes.

We reserve the right to suspend or terminate access for violations of these Terms.

17. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, products and services are provided on an "as is" and "as available" basis.

SuitedNoir makes no warranties, express or implied, including warranties of:

  • Merchantability.

  • Fitness for a particular purpose.

  • Non-infringement.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SuitedNoir shall not be liable for:

  • Indirect damages.

  • Consequential damages.

  • Special damages.

  • Incidental damages.

  • Loss of profits.

  • Loss of business opportunities.

  • Loss of goodwill.

In no event shall SuitedNoir's total liability exceed the amount paid by the customer for the specific order giving rise to the claim.

19. FORCE MAJEURE

SuitedNoir shall not be liable for any delay or failure to perform caused by circumstances beyond its reasonable control, including:

  • Natural disasters.

  • War.

  • Terrorism.

  • Pandemics.

  • Government restrictions.

  • Transportation disruptions.

  • Internet outages.

  • Supplier failures.

20. DISPUTE RESOLUTION

The parties agree to first attempt to resolve disputes through good-faith negotiations.

If a dispute cannot be resolved informally, it shall be resolved through binding arbitration or another dispute resolution process permitted under applicable law before either party initiates court proceedings, except where prohibited by law.

21. LIMITATION PERIOD

Any claim arising out of or relating to an order, product, or use of the website must be brought within one (1) year from the date the claim arose, to the extent permitted by applicable law.

22. GOVERNING LAW

These Terms shall be governed and interpreted in accordance with the laws applicable in the jurisdiction where SuitedNoir operates, without regard to conflict of law principles.

23. CHANGES TO THESE TERMS

SuitedNoir reserves the right to modify these Terms at any time.

Updated Terms will be posted on the website with a revised effective date.

Continued use of the website following any changes constitutes acceptance of the revised Terms.

24. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between SuitedNoir and the customer regarding the use of our website, products, and services.
